PRE-CONTRACTUAL INFORMATION ON CONTRACTS CONCLUDED REMOTELY

1.- ACCEPTANCE OF THE GENERAL CONDITIONS OF USE AND CONTRACTING OF THE WEBSITE

Below is the contractual document that will govern the contracting of services through the website https://www.iepp.es, owned by INSTITUTO EUROPEO DE PSICOLOGÍA POSITIVA S.L. (Hereinafter "IEPP").

Acceptance of this document implies that the user:

  • 1. Has read and is informed of what is set forth herein.
  • 2. That he/she is a person with capacity to contract and assumes all the obligations set forth herein.

These conditions shall apply to contracts made through the website. These General Conditions of Use and Contracting of the website, along with the Special Conditions that may be established, are intended to provide the user with the necessary information and regulate trade relations arising between "IEPP" and users of the web.

Navigation, registration, use and / or purchase of any of the services of the website, imply acceptance as a User, without reservations of any kind, of each and every one of these General Conditions of Use and Contracting that may govern the acquisition of goods and / or the provision of services, as well as, where appropriate, of the Special Conditions if any.

"IEPP" may at any time and without prior notice, modify these General Conditions of Use and Contracting and the Special Conditions by publishing such changes on the website itself so that they can be known by users. Such possible modifications will not affect the services or promotions that were purchased by the User prior to the modification. Therefore, they will not be retroactive.

2.- IDENTITY OF THE PARTIES

And, on the other hand, the user registered on the website by means of a user name and password.

3.- USER REGISTRATION

The User will be able to register on the website. To do this, he/she must provide the personal data required. The registration as a user of the online store will provide access to the website and the acquisition of services.

4.- PURPOSE OF THE CONTRACT

The purpose of this contract is to regulate the contractual relationship between "IEPP" and the user, at the time he/she accepts the purchase during the contracting process.

The contractual relationship of sale involves the provision, in exchange for a certain price publicly displayed through the website, of a specific service.

These General Conditions bind both parties. The effectiveness of this contract operates at the time of the subscription of the order by User's request, through the contracting mechanisms that are enabled on the website, all in accordance with the provisions of the Civil Code (Código Civil) that reflects the principle of the autonomy of the will and agreements between the contracting parties.

5.- TERRITORY

"IEPP" operates through its website in Spanish Territory. The use of this website, as well as any purchase made on it is considered made in Spain, and therefore subject to Spanish laws and regulations in force.

6.- INFORMATION ABOUT SERVICES

The information about each service that the User hires will be collected in the corresponding web page of the service. Likewise, before contracting the service, this information will be provided to him/her by e-mail.

7-. DURATION OF THE SERVICE

This service will have the duration determined in the web page of each service.

8.- PRICE

The price of each service will be the one stipulated in any given moment in our web page.

Prices may change at any time, but (except as stated above) any possible changes will not affect orders already confirmed.

The prices indicated for each service include Value Added Tax (VAT) or other taxes that may be applicable, and in any case will be expressed in the Euro currency (€).

The prices applicable to each service will be those published on the website, and automatically applied by the contracting process in the last phase of it. In any case this will always be previously communicated to users.

9.- OFFER AND ACCEPTANCE

9.1. - REQUEST FOR INFORMATION

The user who is interested in contracting any of our services will contact us by clicking on the "I am interested" button. Once this button is clicked, a pop-up window will appear where the user will have to provide us his contact information (name, surname and a valid email address).

When the registration for any of our trainings is completed, the user can click on the "Reserve" button. He/she will be redirected to a page of our website, where he/she can attend one of the classes of the selected course for free, by clicking on the "access" button and providing us with his/her contact information.

10.- MEANS OF PAYMENT

The means of payment available are those indicated on the website itself during the payment process:

Credit cards will be subject to verifications and authorizations by their issuing entity, but if said entity does not authorize the payment, we will not be held responsible for any delay or non-delivery. If this happens, we will not be able to formalize any contract with you.

"IEPP" will send to the user's email, within the following twenty-four hours (24h) after receiving the formalization of the order, an email acknowledgment of receipt and confirmation of the purchase made. The service order and, therefore, the contract will be understood as formalized.

In monthly services, the user authorizes the periodic payment, in the corresponding debit or credit card, or in the means of payment selected.

11.- PAYMENT OF SERVICES

Payment of the services purchased through the web is made at the time of the purchase. "IEPP" will send an email confirmation of the purchase made.

"IEPP" states that it does not have access or store sensitive data relating to the means of payment used by the User. Only the financial institution processing the payment has access to this data, in order to manage payments and collections.

Once the purchase process is completed, an electronic document is generated in which the contract is formalized. It can be printed by the user.

IEPP reserves the right to cancel services in cases of non-compliance with the terms and conditions outlined in the "Payment of Services" section of these Terms of Use and Contracting.

11.1. INVOICE

IEPP will issue an invoice and send it to the User's email address, in cases where it is requested.

The invoice will be issued in the name of the natural person placing the order, so the User must ensure to give the correct and complete data of the buyer. Subsequent changes will not be possible.

12. TECHNICAL MEANS TO CORRECT ERRORS

The User is informed that, in case he/she detects that an error has occurred when entering data necessary to process his/her purchase request on the Website, he/she may modify them by contacting IEPP through the contact spaces provided on the Website. If necessary, he/she can also contact customer service, and / or use the contact details provided in the first clause (General Information).

Similarly, the User is referred to consult the Legal Notice and General Conditions of Use and, specifically, the Privacy Policy, to obtain more information on how to exercise their right of rectification, as established in Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (RGPD); and in Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights.

13. EXECUTION OF THE SERVICES

The execution of the services will be carried out on the date agreed upon by the parties, according to the appropriate reservation made by the user.p

14. LANGUAGE USED FOR THE FORMALIZATION OF THE CONTRACT

The contracts that "IEPP" perfects with its clients will be in SPANISH.

15. CODE OF CONDUCT

"IEPP" is subject to the Code of Conduct of the Psychologist, which can be consulted in PDF format on the website of the General Council of Psychology of Spain (Consejo General de la Psicología de España). 16. DURATION OF THE CONTRACT.

This contract shall have the duration indicated in the corresponding web page of the service.

17. RIGHT OF WITHDRAWAL

The user shall have the right to withdraw from the contract within 14 calendar days. However, this period will have the following exception provided for in Article 103 of Royal Legislative Decree 1/2007 (Real Decreto Legislativo 1/2007) of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users (Ley General para la Defensa de los Consumidores y Usuarios) and other complementary laws:

"The provision of services, once the service has been fully executed, when the execution has begun, with prior express consent of the consumer and user and with the recognition on his part that he is aware that, once the contract has been fully executed by the entrepreneur, he will have lost his right of withdrawal."

The computation of the period of these 14 calendar days will start from the day of the conclusion of the contract.

This right of withdrawal may be exercised within the period provided by the consumer and user, communicating to the IEPP its decision to withdraw from the contract. For this purpose, the consumer and user will have at his disposal the withdrawal form using the model provided in ANNEX I.

18 - COMPLAINTS AND CLAIMS.

The User can send IEPP their complaints, claims or any other comments he/she wishes to make through the contact details provided at the beginning of these Conditions (General Information).

In addition, "IEPP" has official complaint forms available to consumers and users, which can be requested at any time, using the contact details provided at the beginning of these Conditions (General Information).

Also, if a dispute should arise from the conclusion of this purchase contract between "IEPP" and the User, the User as a consumer may request out-of-court dispute resolution, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of 21 May 2013 on the settlement of consumer disputes online and amending Regulation (EC) 2006/2004 and Directive 2009/22/EC.
